In New Jersey, the penalties for DUI are also based largely upon the offender’s BAC and the number of offenses they already have. The structure is as follows:

  • First offense with a BAC of .08% -.10%: Fine of $250-$400; jail sentence of not more than 30 days at the discretion of the court; 12-48 hours must be spent at an Intoxicated Driver Resource Center over the course of two days; three-month license suspension.

  • First offense with a BAC of .10% or more: Fine of $300-$500; jail sentence of not more than 30 days at the discretion of the court; 12-48 hours must be spent at an Intoxicated Driver Resource Center over the course of two days; license suspension between seven months and a maximum of one year.

  • Second offense with a BAC of .10% or more: Fine of $500-$1,000; jail sentence of no less than 48 hours; two-year license suspension; 30 days community service.

  • Third offense with a BAC of .10% or more: Fine of $1,000; jail sentence of no less than 180 days in county workhouse; 10year license suspension.
